This service is operated by DocumentedHandicappers, LLC. By using the DocumentedHandicappers.com Website (the "Website") you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member ("Member"). If you wish to become a Member, communicate with other Members and make use of our member services (the "Service"), please read this Agreement and indicate your acceptance by following the instructions in the Registration process. Nothing in these Terms of Service should be construed to confer any rights to third party beneficiaries.
This Agreement sets out the legally binding terms for your use, both buyer and seller, of the Website and your Membership in the Service. We reserve the right to modify or terminate this service for any reason, and without notice, without liability to you, any other Member or any third party. We also reserve the right to modify these Terms of Service from time to time without notice. You are responsible for regularly reviewing these Terms of Service so that you will be apprised of any changes. This Agreement includes DocumentedHandicappers.com policy for acceptable use and content posted on the Website, your rights, obligations and restrictions regarding your use of the Website and the Service and DocumentedHandicappers.com's Privacy Policy.
GAMBLING PROHIBITION: All services are strictly for entertainment purposes and may not be used in connection with any form of gambling. Promotion of gambling sites from this site is prohibited. DocumentedHandicappers.com LLC, will not be held liable for any actions created by, through or under any members actions or sports investment recommendations.
Please choose carefully the information you post on DocumentedHandicappers.com and that you provide to other Members. Your DocumentedHandicappers.com profile may not include the following items: telephone numbers and street addresses, and any photographs or avatars posted by you may not contain nudity, violence, or offensive subject matter. Information provided by other DocumentedHandicappers.com Members (for instance, in their Profile) may contain inaccurate, inappropriate or offensive material, products or services and DocumentedHandicappers.com assumes no responsibility or liability for this material.
DocumentedHandicappers.com reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including email) by you, or to restrict, suspend, or terminate your access to all or any part of the Website and/or Services at any time, for any or no reason, with or without prior notice, and without liability.
Eligibility. Membership in the Service is void where prohibited. By using the Website and the Service, you represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. You further represent and warrant that you are 18 years of age or older and that your use of the DocumentedHandicappers.com shall not violate any applicable law or regulation, whether state or local. Your Membership is solely for your personal use, and you shall not authorize others to use your account, including your profile or email address. You are solely responsible for all Content published or displayed through your account, including any email messages, and for your interactions with other members. As part of the registration process, you will be asked to select a username and password and you will be responsible for all activities occurring under your username and for keeping your password secure. We may refuse to grant you a username that impersonates someone else, is or may be protected by trademark or proprietary rights law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.
SELLER AGREEMENT
To begin selling your handicapping advice and posting picks you must first complete the DocumentedHandicpapers.com enrollment form and pay the annual membership fee. There is a non-negotiable, non-refundable annual membership fee of $1,000.00 USD. For new Sellers there is a $250.00 initial set-up fee to begin your monitor trial period. $750.00 balance paid at end of successful trial period and Seller's will be subject to three month probation period in which Sellers are required to maintain a 53% winning average or higher. This payment is an annual reoccurring non-refundable payment. Sign-up fee is to offset marketing, advertisement, promotion, administration or other expenses related to the DocumentedHandicappers.com website seller platform. Posting of picks and all operations are the sole responsibility of the Members. DocumentedHandicappers.com will not be responsible or liable for any mis-information or negligence by through or under said website.
PICKS VERIFICATION & TRIAL PERIOD
All Seller's will first be monitored for a period of thirty (30) days prior to being elgible to becoming a registered Seller. You must submit daily picks for a 30 day period in order to verify the validity of your sports investor services. All Seller's must maintain a winning average of greater than 53% for 30 days to be considered for further evaluation and to activate Seller membership trial period.
PAYMENT TRANSACTIONS and COMPENSATION:
All Payment payouts for sales will be made via PayPal.com end of month to member's email of record on enrollment form at signup.
Members will receive 60% of all sales commissions derived on total sales. All picks are sold in the range of $20.00-$35.00 USD per game.
A minimum of $50.00 USD must be accrued in Sellers Account before a payout request can be submitted.
All revenue from sales not requested for payout after 6 months of account inactivity will revert back to DocumentedHandicappers.com
DocumentedHandicappers.com will not be held responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. Sponsors further reserve the right to disqualify any individual who tampers with the entry process.
Term and Termination. These Terms of Service will apply to your use of the DocumentedHandicappers service. You may terminate your membership immediately at any time, for any reason, by sending an email to support(@)documentedhandicappers.com. We may terminate your membership immediately at any time, for any reason. Once your membership terminates, you will have no right to use the DocumentedHandicappers website platform or services. Our proprietary rights, disclaimer of warranties, indemnities, limitations of liability and miscellaneous provisions shall survive any termination of your membership.
Non Commercial Use by Members. The Website is for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by the DocumentedHandicappers management. Illegal and/or unauthorized use of the Website, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website will be investigated. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from member profiles without notice and may result in termination of membership privileges. Appropriate legal action will be taken by DocumentedHandicappers.com for any illegal or unauthorized use of the Website.
Proprietary rights. By submitting, posting or displaying any Materials on or through the DocumentedHandicappers.com service, you automatically grant to us a worldwide, non-exclusive, sublicenseable, transferable, royalty-free, perpetual, irrevocable right to copy, distribute, create derivative works of, publicly perform and display such Materials. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
That said, our use of your personal information is governed by our Privacy Policy and we will never rent, sell or share your personal information with any third party for marketing purposes without your express permission.
DocumentedHandicappers.com LLC and its affiliates and licensors own and retain all rights in the DocumentedHandicappers.com Web site and service, which contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by DocumentedHandicappers.com, you may not copy, modify, publish, transmit, distribute, perform, display or sell any of DocumentedHandicappers or DocumentedHanicappers Members proprietary information.
You must use the DocumentedHandicappers.com Service in a manner consistent with any and all applicable laws and regulations. You may not engage in advertising to, or solicitation of, any Member to buy or sell any products or services through the Service. Although DocumentedHandicappers.com cannot monitor the conduct of its Members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, DocumentedHandicappers.com reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which DocumentedHandicappers.com deems appropriate in its sole discretion.
The DocumentedHandicappers.com service is made available for your personal, non-commercial use only. Businesses, organizations or other legal entities may not use the DocumentedHandicappers.com service for any purpose.
Disputes. You are solely responsible for your interactions with other Members. DocumentedHandicappers.com, LLC. reserves the right, but has no obligation, to monitor disputes between you and other Members.
Limitation of Liability . UNDER NO CIRCUMSTANCES WILL DOCUMENTEDHANDICAPPERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE DOCUMENTEDHANDICAPPERS.COM SERVICE, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE WEB SITE OR THE SERVICE, WHETHER OR NOT DOCUMENTEDHANDICAPPERS HAS BEEN ADVISED OF THE POSSIBILITY OF ANY DAMAGES. SUCH LIMITATION OF LIABILITY SHALL APPLY (I) WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE DOCUMENTEDHANDICAPPERS.COM SERVICE.
